Municipalities that state intent to annex territory by resolution or ordinance must initiate annexation proceedings within 5 years of the stated intent.

Municipalities exercising territorial jurisdiction without stating intent must initiate annexation proceedings within 5 years of filing a boundary description with the city clerk and county recorder.

Municipalities may continue exercising territorial jurisdiction during the 5-year period while deciding whether to formally annex.

If a municipality fails to initiate annexation proceedings within the required 5-year timeframe, it is prohibited from exercising territorial jurisdiction over that territory for the following 5 years.
