Creates new offense of possession of a firearm while under the influence of alcohol or controlled substance as a Class A misdemeanor when person is incapable of safely operating the firearm.

Exempts firearm possession in person's own dwelling, place of business, or owned/leased land, and permits possession while acting in self-defense if reasonable person would fear serious physical injury or death.

Authorizes law enforcement to request testing of blood, breath, urine, or other bodily substance when probable cause exists; blood tests require a warrant and refusal to submit to testing is admissible as evidence.

Establishes that 0.08% or higher alcohol concentration is prima facie evidence of impairment; violation results in civil penalty up to $1,000 per offense in addition to criminal penalties.

Amends concealed handgun license requirements to disqualify applicants convicted of this offense within three years and mandates license revocation for three years on first conviction and permanent revocation on second conviction.
