Department of Correction and Department of Community Correction shall reimburse counties for housing state inmates when unable to accept them due to insufficient bed space, at rates determined by the Chief Fiscal Officer with consultation and Governor approval.

Reimbursement begins on sentencing date if judgment and commitment order received within 21 days; if received after 22 days, reimbursement begins on date of receipt.

Both departments must prepare monthly invoices listing state inmates in county jails, forward to county sheriffs for certification of actual days housed, and make payment within 5 business days of receiving certified invoices.

Counties must maintain documentation for 3 years confirming inmate housing dates, subject to review by Arkansas Legislative Audit; invoices may be mailed or sent electronically.

Reimbursement rate shall increase by $5.00 per day per inmate effective upon bill passage, then increase by $1.00 per day per inmate annually on January 1 for the next 25 years.
