State agencies shall attempt to ensure 10% of total state-funded and state-directed public construction programs and purchases of goods and services are paid to minority business enterprises each fiscal year.

State agencies must send each request for proposals to the Division of Minority Business Enterprise of the Arkansas Economic Development Commission for distribution to minority business enterprises.

State agencies must submit quarterly reports within 15 days of the close of each three-month period to the Minority Business Advisory Council detailing total procurement, dollar value, and percentage of contracts awarded to minority business enterprises.

The Minority Business Advisory Council must compile quarterly reports and submit them to the Legislative Council or Joint Budget Committee by the 25th day after the close of each three-month period.

Purposeful violation of the Minority Business Economic Development Act provisions constitutes a Class D felony upon conviction.
