HB2208 Summary

• Amends Arkansas Code § 20-10-2007 to subject persons operating unlicensed assisted living or residential care facilities to the same penalties as unlicensed long-term care facilities.

• Requires unlicensed facilities serving unrelated individuals unable to care for themselves to comply with rules for licensed residential care facilities promulgated by the Office of Long-Term Care.

• Grants the Department of Human Services authority to enforce regulations against unlicensed facilities and to seek injunctions prohibiting noncompliant facilities from operating.

• Authorizes the Department of Human Services to enter and inspect suspected unlicensed assisted living or residential care facilities without a warrant and to seek injunctions prohibiting operation if facility denies or interferes with inspections.
