AR HB2228

Amends Arkansas Code Title 12, Chapter 12, Subchapter 1 to establish requirements for investigating officer-involved deaths (deaths resulting from acts or omissions of law enforcement officers on or off duty within scope of duties).

Requires law enforcement agencies to maintain written policies mandating investigations be conducted by at least two investigators, neither of whom is employed by the officer's agency, with one designated as the lead investigator.

For traffic-related officer-involved deaths, requires use of a crash reconstruction unit from an outside law enforcement agency, except state law enforcement agencies may use their own crash reconstruction unit for investigations involving their own officers.

Permits internal investigations to occur simultaneously with the independent investigation as long as they do not interfere with the independent investigation.

Requires investigators to provide a written report to the prosecuting attorney in the county where the death occurred, and mandates public release of the report if the prosecutor determines there is no basis for prosecution, after deleting information exempt from disclosure under the Freedom of Information Act of 1967.
