Defines "unused or underutilized public school facilities" as facilities not being used for educational purposes and not subject to existing leases or purchase offers as of the bill's effective date.

Requires school districts to submit annual reports by February 1 identifying all unused or underutilized facilities in their district, with the Division of Public School Academic Facilities able to identify facilities the district fails to report.

Grants public charter schools the right to lease or purchase unused or underutilized facilities at fair market value, with a 60-day negotiation period; if no agreement is reached, charter schools may petition the Commission for Arkansas Public School Academic Facilities and Transportation to order a lease for 5-30 years.

Provides school districts grounds to deny a charter school's petition only if they demonstrate by preponderance of evidence that the facility will be needed for future growth or that charter school use would materially harm the educational environment within 500 feet.

Establishes rights of first refusal for public charter schools when school districts decide to sell or lease facilities, with delays of 2-3 years before districts may sell to third parties, and allows districts to petition for waivers if no charter school expresses interest within the specified timeframe.
