Amends Arkansas Code § 20-27-1804 to clarify that smoking prohibitions in publicly owned places of employment do not apply to privately owned businesses.

Repeals Arkansas Code § 20-27-1805, eliminating exemptions that previously allowed certain establishments (hotels, restaurants, bars, tobacco retailers, and gaming facilities) to permit smoking in designated areas.

Adds provision allowing privately owned businesses to voluntarily choose to follow State Board of Health rules regarding smoking prohibitions and to allow Department of Health inspections.

Maintains mandatory smoking prohibitions in all publicly owned vehicles and enclosed areas, including common work areas, auditoriums, classrooms, conference rooms, elevators, hallways, health care facilities, cafeterias, lounges, restrooms, and other enclosed spaces.

Prohibits discrimination or retaliation against employees who report smoking violations and requires employers to communicate smoking prohibitions to current and prospective employees.
