Agencies must repeal at least one existing rule before adopting a new proposed rule, unless the proposed rule is specifically required by the General Assembly or is an emergency rule.

Any repealed rule must be eliminated before the effective date of the proposed rule.

Agencies must base all rule adoptions, amendments, and repeals on the best reasonably obtainable scientific, technical, economic, or other evidence and information available.

Agencies must adopt the least costly rule considered, unless additional benefits of a more costly rule justify the extra cost, the agency provides written explanation, the reason relates to public health/safety/welfare, and the decision falls within the agency's statutory authority.
