AR SB745

Creates Arkansas Code § 20-16-604 prohibiting any person from performing, inducing, or attempting to perform an abortion on a pregnant woman in state custody, except in cases of medical emergency as defined by reasonable medical judgment.

Defines "state custody" as situations where a state agency has care and control over an individual who is a ward of the state (including foster children), incompetent with state-named guardians, incarcerated, or institutionalized without legal guardians.

Prohibits state agencies and employees from providing transportation related to abortion services or services recommending abortion for pregnant women in state custody.

Allows pregnant women in state custody to petition circuit courts to be temporarily removed from state custody to obtain an abortion under existing § 20-16-804 procedures, though state agencies cannot provide transportation for abortion-related services even after removal.

Amends existing statutes (§ 9-27-353, § 9-34-202, § 12-18-617, § 12-18-1003) to add exceptions referencing the new § 20-16-604 abortion prohibition to medical care and treatment provisions.
