AR SJR13

Proposes a new constitutional section § 30 allowing parties in civil actions to recover reasonable attorney's fees and litigation costs from opposing parties who assert claims or defenses that are not well-grounded in law or fact, not warranted by existing law, or interposed for improper purposes.

Amends Article 5, § 32 to authorize the General Assembly to set the amount of punitive damages awarded in civil actions seeking recovery for injuries resulting in death or injuries to persons or property.

Establishes that punitive damages set by law must be at least 5 times the compensatory damages award against all defendants, unless compensatory damages are already limited by law.

Maintains existing constitutional protections preventing limitations on compensatory damages recovery for personal injuries or death, except where specific statutory limits on compensatory damages apply.

Requires voter approval at the next general election for the amendment to become part of the Arkansas Constitution.
