AR HB1040

Creates new offense of making, drawing, uttering, or delivering a check, draft, order, or electronic account information presentment that is dishonored and marked "refer to maker" when the maker knew of the reason for dishonor.

Establishes misdemeanor penalties for dishonored checks of $1,000 or less: first offense up to $500 fine or 30 days jail; second offense up to $1,000 fine or 90 days jail; third or subsequent offense up to $2,000 fine or 1 year jail.

Establishes felony penalties for one or more instruments totaling over $1,000: Class B felony for $25,000 or more; Class C felony for $5,000-$24,999; Class D felony for $1,000-$4,999.

Applies felony penalties when multiple dishonored checks or transactions are drawn within a 90-day period and the combined total meets the threshold amounts.
