HB 1070 Summary

• Creates the Transformation and Efficiencies Act of 2019 establishing 15 cabinet-level departments as executive agencies reporting directly to the Governor: Agriculture, Commerce, Corrections, Education, Energy and Environment, Finance and Administration, Health, Human Services, Inspector General, Labor and Licensing, Military, Parks/Heritage/Tourism, Public Safety, Transformation and Shared Services, and Veteran Affairs.

• Each cabinet-level department shall be headed by a secretary appointed by the Governor who serves at the Governor's pleasure and may delegate powers, hire personnel, and perform administrative functions for all state entities transferred to the department.

• Transferred state entities retain their statutory authority, powers, duties, and functions (including rule-making and licensing authority) but have administrative functions managed by the cabinet-level department, with all personnel becoming department employees.

• All revenues, records, unexpended appropriations, and property of transferred entities continue to be held and used solely for their original designated purposes; real property remains in the entity's name but is administered by the department.

• Effective date is July 1, 2019, and empowers the Arkansas Code Revision Commission to correct technical errors in the Arkansas Code necessary to implement this reorganization when revisions are technical in nature and consistent with the chapter's intent.
