Repeals Arkansas Code § 20-48-105 regarding nonprofit community programs and expansion of nonresidential services to adults with developmental disabilities.

Repeals Arkansas Code §§ 20-48-1104 through 20-48-1106 that established requirements for determining underserved status and certification of early intervention day treatment service providers for children.

Adds new Arkansas Code § 20-48-106 requiring the Division of Developmental Disabilities Services to promulgate rules governing standards of operations and closure, sale, transfer, or expansion of facilities providing child health management services, developmental day treatment clinic services for children, or nonresidential services to adults with developmental disabilities.

Requires the division to file proposed rules with the Secretary of State by August 1, 2019, or as soon as practicable after Legislative Council approval under § 10-3-309.

Establishes legislative intent to reduce limitations for early intervention day treatment services to children and nonresidential services to adults with developmental disabilities.
