AR HB1411

Expands the definition of "motor vehicle" under Arkansas DWI/BWI law to include all-terrain vehicles and agricultural vehicles (such as tractors) operated off-road or in agricultural settings.

Excludes certain vehicles from the motor vehicle definition: mobility assistance devices, motorized scooters/toys, bicycles with small motors under 20 m.p.h., riding lawnmowers not on public roads, electric personal assistive mobility devices under 20 m.p.h., and human-powered or rail-based devices.

Adds "serious physical injury" to the definition of accidents triggering mandatory blood alcohol testing, expanding requirements beyond fatal accidents to include those causing substantial risk of death or protracted disfigurement, health impairment, or bodily dysfunction.

Requires chemical testing of breath, saliva, or urine for drivers/operators involved in accidents resulting in loss of life, possible death, or serious physical injury to determine alcohol concentration or controlled substance presence.

Designates Section 2 of the act as "Jacob's Law."
