HB 1436 Summary

• Amends Arkansas Code § 14-16-116 to authorize counties to exchange or transfer real or personal property with other counties, municipalities, community colleges, and institutions of higher education.

• Allows counties to exchange real property with individuals or nonprofit corporations when determined to be in the best interest of the county.

• Requires any property exchange or transfer to be authorized by ordinance of the quorum court, confirmed by a two-thirds vote, and filed with the county clerk along with a bill of sale documenting the terms and conditions.

• Permits counties to accept service, legal tender, or other consideration as payment in exchange for real or personal property.

• Exempts transfers made under this section from requirements under Arkansas Codes §§ 14-16-105, 14-16-106, § 14-22-101 et seq., and the Arkansas Procurement Law.
