Amends Arkansas Code § 2-16-203(b)(1)(A)(ii)(b) to clarify that a violation is egregious only when one of three herbicides is used intentionally in violation of federal label requirements or state law or rules: Dicamba, an auxin-containing herbicide, or a new herbicide technology released after August 1, 2017.

Removes the previous requirement that "significant off-target crop damage" must occur as a result of the herbicide application to constitute an egregious violation.

Declares an emergency to allow the State Plant Board to enforce egregious violations during the 2019 growing season to protect the state's agricultural economy.

Makes the act effective immediately upon the Governor's approval, or if neither approved nor vetoed, upon the expiration of the veto period, or if vetoed and overridden, upon the date of the last house override.
