Repeals Arkansas Code § 11-10-210(f)(21), which previously excluded personal care services from the definition of "employment" in the Department of Workforce Services Law.

Eliminates the exemption that allowed home- and community-based health services providers licensed under § 20-10-2301 et seq. to classify personal care workers as independent contractors rather than employees.

Makes the repeal retroactive to January 1, 2010.

Establishes legislative intent that individuals performing personal care services for home- and community-based service providers are employees of those providers, not independent contractors, effective upon the act's passage.
