Division of Developmental Disabilities Services must promulgate rules regarding standards of operations and procedures for closure, sale, transfer, or expansion of facilities and services provided by developmental disabilities providers.

Rules apply to providers of child health management services and developmental day treatment clinic services for children, including any successor early intervention day treatment programs.

Rules apply to providers of nonresidential services to adults with developmental disabilities, including adult developmental day treatment providers.

Final rules must be filed with the Secretary of State for adoption by August 1, 2019, or as soon as practicable after Legislative Council approval under § 10-3-309 if approval has not occurred by that date.

Division must file proposed rules with the Legislative Council sufficiently in advance of August 1, 2019, to allow consideration and approval before that deadline.
