School districts and public charter schools shall adopt policies authorizing school nurses and certified employees to administer epinephrine auto-injectors and albuterol to students in emergency situations.

School nurses and certified employees are granted immunity from liability when administering epinephrine auto-injectors to students in anaphylactic reactions or albuterol to students in perceived respiratory distress, except in cases of intentional or willful and wanton misconduct.

School districts and public charter schools may acquire and stock albuterol supplies authorized by physicians, advanced practice registered nurses, or physician assistants, and may enter agreements with manufacturers to obtain albuterol at reduced prices or free of charge.

Schools must designate a trained employee responsible for storage, maintenance, and distribution of stocked albuterol supplies and maintain epinephrine auto-injectors in locked, secure locations.

Physicians, advanced practice registered nurses, and physician assistants may issue certificates authorizing school personnel trained in albuterol administration to possess and administer the medication.
