AR HB1754

Amends Arkansas Code § 5-54-119 to add a new offense of "delivering a prohibited article" to the existing furnishing, possessing, and using prohibited article offenses.

Establishes that an inmate knowingly delivering a controlled substance to another person is a Class A felony if the substance causes death or serious bodily injury, or a Class B felony otherwise.

Adds controlled substances to the list of prohibited articles that inmates cannot knowingly possess, making such possession a Class B felony.

Prohibits conviction for furnishing, possessing, or delivering a controlled substance under this statute if the person has already been charged, tried, or convicted of a possession or delivery offense under the Uniform Controlled Substances Act arising from the same facts.

Preserves existing exemption for religious officials supplying sacramental wine to inmates for approved religious services pursuant to Board of Corrections regulations.
