AR HB1834

Prohibits state entities (including cities, counties, higher education institutions, school districts, and political subdivisions) from discriminating against or granting preferential treatment based on race, gender, color, ethnicity, or national origin in state employment, public education, and state procurement.

Allows consideration of bona fide gender-based qualifications reasonably necessary for normal state functions, does not invalidate existing court orders or consent decrees, and permits actions necessary to maintain federal program eligibility.

Establishes that violations constitute a Class A misdemeanor if done negligently.

Allows individuals believing their rights were impacted to bring civil action in circuit court seeking injunctive relief and recovery of reasonable court costs and attorney's fees.

Requires courts finding a violation to award both injunctive relief and court costs and attorney's fees to the prevailing party.
