AR HB1851

Amends Arkansas Code § 9-15-207(b) to update the federal firearm prohibition reference from January 1, 2007 to January 1, 2019 for individuals subject to orders of protection or convicted of domestic violence misdemeanors.

Adds two new notice requirements to orders of protection requiring respondents to refrain from harassing, stalking, or threatening protected persons and from engaging in conduct that places them in reasonable fear of bodily injury.

Creates new subsection (h) requiring every order of protection to include either a finding that the respondent presents a credible threat to the physical safety of protected persons or an explicit prohibition against use or threatened use of physical force that would cause bodily injury.

Maintains existing penalties: Class A misdemeanor violation carrying up to one year jail time or $1,000 fine, and Class D felony for violations within five years of a previous conviction for violating an order of protection.
