AR SB170

Prohibits counties and municipalities from regulating residential building design elements, including exterior color, cladding material, roof style, windows/doors, room count, interior layout, and minimum square footage.

Excludes from the prohibition: structures in historic districts, those subject to private covenants, regulations related to building/safety codes, manufactured housing, National Flood Insurance Program requirements, and central business improvement districts.

Exempts multifamily residential structures and other non-single-family dwellings from the prohibition.

Grandfathers in existing county and municipal policies, regulations, or ordinances affecting residential design elements on properties as of February 28, 2019, but does not apply to other properties thereafter.

Permits overlay district regulations if property owners receive notice, a majority of property owners petition in support, and the overlay district determines compliance with the Private Property Protection Act.
