SB411 Summary

• Effective January 1, 2020, prohibits municipalities in Arkansas from enacting or adopting sanctuary policies under Arkansas Code § 14-1-103.

• Municipalities that enact sanctuary policies become ineligible for discretionary state funds and grants until the policy is repealed or no longer in effect.

• Defines "sanctuary policy" to include policies that limit cooperation with federal immigration agencies, grant unlawful status to immigrants, violate 8 U.S.C. § 1373, restrict ICE detainers, or prevent law enforcement from asking about citizenship or immigration status.

• Authorizes the Attorney General to issue opinions on whether municipalities violate the law upon complaint by state residents or request by General Assembly members, with municipalities able to appeal to Pulaski County Circuit Court.

• Exempts records created during administrative investigations related to this section from disclosure under the Freedom of Information Act.
