SB450 - Arkansas New Farm Machinery Quality Assurance Act

• Establishes warranty protections for new farm machinery purchased or leased after January 1, 2020, requiring sellers to provide written disclosures of consumer rights at time of purchase or lease.

• Defines a quality assurance period lasting 12 months from delivery or first 600 hours of operation (whichever is earlier), during which manufacturers must repair nonconforming equipment or provide refunds/replacements.

• Allows manufacturers up to 3 repair attempts for the same issue (or 30 days out of service) if repairs total at least 30% of purchase price, or up to 5 repair attempts for all issues (or 60 days out of service) if repairs total at least 50% of purchase price.

• Requires consumers to provide written notice by certified mail to report nonconformities and attempt mediation through an Arkansas Alternative Dispute Resolution Commission-certified mediator before filing lawsuits (unless seller failed to provide required disclosures).

• Entitles prevailing consumers to recover full refunds or comparable replacement machinery plus collateral charges, with attorney's fees and costs based on actual time expended and charges reasonably incurred; establishes 2-year statute of limitations for legal actions.
