Amends Arkansas Code § 25-19-103(7) to change the presumption that records maintained in public offices or by public employees "shall be" public records to "are presumed to be" public records.

Clarifies that "public records" includes records maintained by private foundations with the primary purpose of providing direct financial support to public universities, colleges, or their employees.

Exempts identifying information of donors, potential donors, non-donors, and individual donor amounts to private foundations from the definition of public records.

Maintains that purchased, leased, or licensed software does not constitute public records.
