Requires all custodial interviews and interrogations at law enforcement facilities to be recorded by audio medium at minimum, with visual media if available.

Requires custodial interviews and interrogations outside law enforcement facilities to be recorded by audio and visual media if available, but audio recording is the minimum requirement.

Law enforcement officers must document in reports the reason why visual media was not used when only audio recording occurs.

Exempts recordings in cases of routine prisoner processing, equipment malfunction after good faith attempts, spontaneous statements, exigent circumstances, and interviews conducted by parole or probation officers.

Allows suspects to request non-recording of interviews, which constitutes a waiver of recording rights; law enforcement agencies must retain original recordings for a minimum of three years.
