Senate Bill 602 - Small Wireless Facility Deployment Act

• Establishes the "Small Wireless Facility Deployment Act" as a new subchapter of Arkansas Code Title 23, Chapter 17, effective September 1, 2019

• Grants wireless providers the right to collocate small wireless facilities and install associated poles in public rights-of-way as a permitted use, without zoning review, subject to compliance with height limits (50 feet or 10% taller than adjacent structures) and applicable codes

• Sets capped application fees at $100 per small wireless facility or $250 for pole installation with collocation, and annual compensation rates of up to $30 per facility in rights-of-way or $240 per authority pole

• Requires authorities to process applications within 60 days for facility collocation or 90 days for pole installation on a nondiscriminatory basis, with automatic approval if deadlines are missed without action

• Prohibits exclusive arrangements for pole attachments, restricts make-ready work requirements to what is necessary for code compliance, and preserves Arkansas Public Service Commission jurisdiction over electric utility pole attachments
