Governmental entities may waive certain procedures under the Arkansas Administrative Procedure Act (§ 25-15-201 et seq.) when replacing only the term "regulation" with "rule" in existing rules without substantive changes.

Agencies must file updated rules with the Secretary of State on or before January 1, 2020 to qualify for the exemption.

Agencies must provide a letter to the Legislative Council stating the rule name, brief description, and confirming that only the terminology change from "regulation" to "rule" was made.

Agencies may continue to follow the standard § 25-15-204 procedure for adopting rules that change this terminology if they choose to do so.
