Extends the lookback period for prior DWI/boating while intoxicated convictions from 5 years to 10 years for determining second, third, and fifth or subsequent offenses.

Increases the lookback period from 10 years to 20 years for sixth or subsequent offenses to qualify as a Class B felony.

Changes sentencing language from "is upon conviction" to "is guilty of" for clarity in misdemeanor and felony classifications.

Applies retroactively to cases that have not reached final judgment as of the bill's effective date, with exceptions for offenses occurring before July 22, 2015.

Maintains existing penalties for first offenses and preserves the affirmative defense that operators cannot be more than 2 years older than minor passengers.
