HB1112 Summary

• Allows voters casting provisional ballots without required identification to have ballots counted by completing a sworn statement (under penalty of perjury, not requiring notarization) at the polling site stating they are registered and are the person registered to vote

• Permits provisional ballots cast by voters without identification to be counted if voter returns to county election board or county clerk by 12:00 noon on Monday following election and presents required identification document

• Applies same provisional ballot procedures to absentee voters who fail to submit required identification documentation, allowing them to complete sworn statements or return copies of identification by the Monday deadline

• Requires State Board of Election Commissioners to promulgate rules implementing the provisional ballot procedures, including preparation of sworn statement forms

• Modifies Arkansas Code § 7-5-308 to restructure provisional ballot procedures and clarifies that poll workers must inform voters they may complete a sworn statement as an alternative to providing identification at polling sites
