AR HB1329

Amends Arkansas Code § 16-90-1407 to allow persons to petition the court to seal records of felony convictions for possession of controlled substances under § 5-64-419 or counterfeit substances under § 5-64-441 after sentence completion.

Requires that prior to sentencing, a court-appointed intake officer must determine the person has a drug addiction and recommend them as a candidate for residential drug treatment.

Mandates the court place the person on probation with conditions requiring successful completion of a court-approved drug treatment program and remaining drug-free until probation is successfully completed.

Allows sealing of the conviction record only if the person successfully completes all terms and conditions of the probation.
