AR HB1426

Creates the Arkansas Fair Food Delivery Act as a new subchapter of Arkansas Code Title 4, Chapter 75, regulating food delivery platforms operating in the state.

Requires food delivery platforms to enter into a written agreement expressly authorizing them to take and deliver food orders before delivering any food from a food facility.

Allows food facilities to bring civil actions to enjoin violations and obtain injunctions against unauthorized delivery services.

Establishes escalating civil penalties for bad faith violations: $500 minimum for first violation, $1,000 for second violation, and $1,500 for third or subsequent violations, plus attorney's fees.

Authorizes the Arkansas Attorney General or any prosecuting attorney to bring enforcement actions against violating food delivery platforms; effective January 1, 2022.
