Requires in-home caregivers for Medicaid beneficiaries to pass registry records checks and criminal background checks before being paid with Medicaid funds.

Department of Human Services must require a state criminal background check through Arkansas State Police and a federal criminal background check (for those not continuously residing in Arkansas for 5 years) through the Federal Bureau of Investigation.

Registry records checks must include reviews of the Child Maltreatment Central Registry and the Adult and Long-Term Care Facility Resident Maltreatment Central Registry.

Caregivers and applicants are responsible for paying all fees associated with registry records checks and criminal background checks.

Individuals who have pled guilty or been found guilty of felonies or crimes involving moral turpitude or dishonesty, or who appear on either maltreatment central registry, are ineligible to provide Medicaid-funded services.
