AR HB1704

Adds Arkansas Code § 14-1-104 to define "auxiliary container" as bags, cups, packages, containers, bottles, or similar packaging made of cloth, paper, plastic, aluminum, glass, cardboard, or recycled material designed for consumption, transportation, or protection of merchandise, food, or beverage at food service, manufacturing, distribution, processing, or retail facilities

Prohibits municipalities and counties from restricting, taxing, prohibiting, or regulating the use, disposition, or sale of auxiliary containers

Permits municipalities and counties to operate recycling, composting, and solid waste disposal programs and regulate auxiliary containers on property they own or maintain

Preserves municipalities' and counties' authority to restrict glass containers based on public safety concerns, enforce littering ordinances complying with the Litter Control Act, and set alcohol possession standards in designated entertainment districts

Does not affect general state or local sales and use taxes
