Arkansas Racing Commission shall require employees of franchise holders or casino licensees who conduct wagering on casino gaming games or devices to obtain a license from the commission.

License applicants must be fingerprinted and undergo statewide criminal and noncriminal background checks through the Arkansas State Police Division.

Fingerprints are forwarded to the Federal Bureau of Investigation for a national criminal history record check after completion of statewide checks.

Background check information must be kept confidential by the commission and used only to determine applicant suitability for licensing, though results may be disclosed to the applicant.

The commission may exempt certain classes of licenses from background check requirements through promulgated rules, and knowingly making false statements on a license application is a Class A misdemeanor.
