AR HB1859

Authorizes Arkansas Highway Police Division to use automated enforcement devices to detect and enforce traffic violations in highway work zones when construction personnel are present, both outside and within municipal boundaries.

Requires a certified law enforcement officer to be physically present with the automated enforcement device and issue citations to violators at the time and place of the violation.

Defines "construction personnel" as employees of the Arkansas Department of Transportation, counties, municipalities, or their contractors.

Defines "highway work zone" as any area on or adjacent to highways, roads, or streets where construction, reconstruction, maintenance, or other work is being performed or is in progress.

Clarifies that "law enforcement officer" includes members of Arkansas State Police, Arkansas Highway Police Division, other certified full-time state and local law enforcement officers, and court personnel in Arkansas.
