AR HB1878

Adds comprehensive definition of fentanyl to Arkansas law to include fentanyl analogs and any chemical structure modifications (isomers, esters, ethers, salts)

Creates new felony offenses for fentanyl: simple possession is Class C felony, possession with intent to deliver is Class A felony, delivery is Class Y felony, and manufacture is Class Y felony

Includes affirmative defense to fentanyl possession charges if person has valid prescription and uses fentanyl lawfully

Exempts lawful manufacturing, delivery, and prescribing of fentanyl by licensed pharmaceutical companies, wholesalers, pharmacies, hospitals, and medical providers

Lowers trafficking threshold for fentanyl to 1 gram or more (compared to 200 grams for methamphetamine and heroin) and establishes it as Class Y felony
