Agencies must have specific statutory authority to assess or impose fees and penalties, either for a certain type and amount or to impose fees in general.

Agencies assessing or imposing fees or penalties must promulgate them by rule, unless the specific amount is set directly by statute.

All rules assessing or imposing fees or penalties must be submitted to the Legislative Council for review and approval before the agency can implement them.

Legislative committees reviewing rules containing fees or penalties are not required to state grounds for disapproval and may reject such rules for any reason.

The law does not affect agencies' authority to deny, suspend, or revoke licenses within their regulatory authority.
