AR SB193

Adds Arkansas Code 25-1-125 prohibiting the State of Arkansas, cities, counties, institutions of higher education, public school districts, and political subdivisions from discriminating against or granting preferential treatment based on race, gender, color, ethnicity, or national origin in state employment, public education, and state procurement.

Allows consideration of bona fide gender-based qualifications reasonably necessary for normal state functions and does not invalidate existing court orders or consent decrees in effect as of the effective date.

Permits actions necessary to maintain eligibility for federal programs where ineligibility would result in loss of federal funds and does not preempt existing state or federal discrimination laws.

Establishes criminal penalty of Class A misdemeanor for negligent violations of the section.

Allows individuals to bring civil actions in circuit court to enjoin violations and recover reasonable court costs and attorney's fees, with courts required to award injunctive relief and costs if a violation is found.
