AR SB195

Amends Arkansas Code § 25-19-102 to clarify that the Freedom of Information Act of 1967 is intended to provide transparency and that electors and their representatives should be able to learn about public officials' activities.

Establishes legislative intent that records of private organizations or entities performing governmental functions or supporting governmental agencies through fundraising or labor are subject to the Freedom of Information Act.

Expands the definition of "public records" in Arkansas Code § 25-19-103(7) to include records maintained by private entities that provide direct financial support of $1,000,000 or more or in-kind support equivalent to $1,000,000 or more to a state governmental agency or state public entity in the previous calendar year.

Excludes from "public records" definition records of private entities not related to direct government support and names and personal contact information of persons making financial donations to qualifying private entities.

Clarifies that software acquired by purchase, lease, or license is not considered public records.
