AR SB399

Amends Arkansas Code § 19-11-223(b) to modify mandatory state contract requirements for state agencies purchasing commodities, technical and general services, and professional and consultant services.

Allows state agencies to exempt themselves from mandatory state contracts if they demonstrate to the director that substantial savings will likely be effected by purchasing outside the mandatory state contract.

Requires exemption approvals from mandatory state contracts to be issued in writing, while denials do not require written documentation.

Mandates that state agencies exempt from mandatory state contracts must keep records as required by rule to evidence the actual savings realized from purchasing outside the mandatory state contract.

Preserves existing exemption provisions under § 19-11-233.
