SB 466 Summary

• Adds definition of "Operation" to the Child Welfare Agency Licensing Act to mean a child welfare agency actively engaged in at least one qualifying child welfare activity.

• Clarifies that nonpsychiatric residential treatment facilities licensed under the Child Welfare Agency Licensing Act are not subject to § 20-10-101 et seq. regulations.

• Exempts child welfare agencies with capacity licensed as of March 1, 2003 from obtaining permits from the Office of Long-Term Care and Health Services Permit Agency, except when expanding capacity or serving only non-Arkansas residents.

• Requires the board to terminate licenses of agencies that have not been in operation for a consecutive twelve-month period, and allows the Department of Human Services to recommend revocation or suspension for failure to operate or maintain substantial compliance for six consecutive months.

• Establishes that licenses are effective unless revoked, suspended, or terminated by the board.
