AR SB529

Amends the definition of "dealer" under the Dealer in Secondhand Goods Reform and Disclosure Act to explicitly include pawnbrokers licensed by the Pawnbroker Licensure Commission or as defined under existing law.

Establishes that owners of stolen property may request a dealer return the property without charge or provide full restitution by signing an affidavit and filing it with local law enforcement.

Defines "full restitution" as the higher of either the fair market value of the stolen property or the amount for which it was sold.

Requires dealers to deliver stolen property to the owner or pay full restitution within seven (7) days after receiving the affidavit and written release from law enforcement, unless reasonable cause exists.

Allows owners to file a replevin action to recover property if the dealer refuses to make an election, with courts authorized to award and apportion costs and attorney's fees based on case facts.
