School districts and open-enrollment public charter schools must adopt a policy detailing how pupil attendance records are kept for students in virtual or remote learning programs if the method differs from standard in-person attendance tracking.

The attendance policy requirement applies when the method for documenting virtual or remote learning attendance differs from the method required for traditional daily attendance records.

Motor vehicle operator's license suspension provisions for students 14 years of age or older who are no longer in school apply with equal force to students attending school via virtual or remote learning programs.

The department may promulgate rules to carry out the intent of motor vehicle license suspension requirements and must distribute copies of all adopted rules to public, private, and parochial schools and adult education programs.
