SB717 Summary

• Declares federal firearms regulations enacted after April 23, 2021 null and void in Arkansas, including most of the National Firearms Act and Gun Control Act of 1968, with specified exceptions for certain federal criminal provisions.

• Prohibits Arkansas state employees, law enforcement officers, and local government officials from enforcing or assisting federal agencies in enforcing federal firearm regulations that conflict with the Arkansas Constitution Article 2, § 5.

• Creates criminal penalties of $500 for state/local officials who knowingly assist federal enforcement and $500-$1,000 fines for supervisory officers who direct such assistance.

• Extends protections to other Arkansas constitutional rights including assembly, speech, due process, and searches and seizures, with same enforcement prohibitions and penalties applied.

• Grants Arkansas citizens a civil cause of action for declaratory judgment and monetary damages against any person or entity attempting to enforce the prohibited federal regulations.
