SB73 Summary

• Adds four new definitions to Arkansas Code § 25-43-103: "complete state entity transfer" (transfer of independent state entity to cabinet department), "independent state entity" (entity not part of cabinet department), "independent state entity transfer" (transfer of functions from cabinet to independent entity), and "interdepartmental state entity transfer" (transfer between cabinet departments).

• Creates § 25-43-112 establishing procedures for complete state entity transfers, including transfer of statutory authority, powers, duties, functions, records, personnel, property, and unexpended appropriations; existing orders and rules continue in effect until amended or repealed.

• Creates § 25-43-113 permitting state entities previously transferred to cabinet departments to be re-established as independent entities, with transfer of administrative functions, employees, positions, revenues, records, and property while maintaining employee civil service rights and protecting special fund designations.

• Creates § 25-43-114 establishing powers and duties of independent state entities to execute prescribed powers, administer transferred entities, make contracts and employ staff, and perform administrative functions.

• Creates § 25-43-117 establishing procedures for interdepartmental state entity transfers between cabinet departments, including transfer of statutory authority, powers, duties, functions, records, personnel, and property with preservation of existing orders and regulations.
