Private schools receiving any state funding must administer the statewide student assessment system annually on the same schedule as public schools, with all costs covered entirely by the private school.

Private schools must report individual student assessment results to parents or guardians, consistent with requirements for public schools.

Private schools that accept state funds must admit any student who applies for admission and intends to use state funds to cover costs, unless the school has reached its maximum student-to-teacher ratio permitted under federal or state law.

Private schools accepting state funds must submit a capacity report to the Division of Elementary and Secondary Education by May 31 each year detailing enrollment capacity for the upcoming school year.

"Private school" is defined as any nonpublic school offering instruction in grades K-12 in Arkansas that receives any form of state funding, including funds from the Philanthropic Investment in Arkansas Kids Program or the Succeed Scholarship Program.
