HB1334 Summary

• Creates the Restroom Access Act requiring retail establishments with employee toilet facilities to allow customers with eligible medical conditions access during normal business hours if the facility is reasonably safe.

• Defines eligible medical conditions as Crohn's disease, ulcerative colitis, inflammatory bowel disease, irritable bowel syndrome, or any other condition requiring immediate toilet access.

• Requires customers to provide evidence of their condition through physician statement or identification card from a nationally-recognized health organization.

• Permits access only when at least 3 employees are present, no public restroom is immediately available, and the facility location does not create health, safety, or security risks.

• Exempts filling stations and service stations with 800 square feet or less from the requirement and shields retail establishments from civil liability for non-willful acts or omissions occurring in non-public areas.
